These Terms & Conditions ('Terms') govern your use of the Tigerdot™ website and the professional services provided by Tigerdot™, a brand strategy and design studio operated by Victoria [Surname], Hertfordshire, UK ('we', 'us', 'our').
By accessing our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our website or engage our services.
These Terms should be read alongside any project proposal, contract, or Statement of Work ('SOW') issued by Tigerdot™. In the event of a conflict between these Terms and a signed contract, the signed contract shall take precedence.
1. Our Services
Tigerdot™ provides brand strategy, brand identity design, and related creative services to businesses and entrepreneurs. We work exclusively with clients whose values align with ours. We reserve the right to decline any project without obligation to provide a reason.
The scope, deliverables, timeline, and fees for each project will be set out in a written proposal or Statement of Work, which forms part of the agreement between us. No work will commence until a proposal has been agreed and any required deposit received.
2. Proposals & Agreements
Proposals are valid for 14 days from the date of issue unless otherwise stated
Acceptance of a proposal constitutes a binding agreement between you and Tigerdot™
Any changes to the agreed scope must be confirmed in writing by both parties
Verbal agreements do not form part of the contract and will not be honoured unless confirmed in writing
3. Fees & Payment
Deposit
A non-refundable deposit of 50% is required before any work begins, unless otherwise specified in the proposal. This deposit secures your project slot and covers initial strategy and research work.
Remaining Balance
The remaining balance is due upon completion of the project, prior to the transfer of final files, unless a different payment schedule is outlined in your proposal.
Invoicing & Late Payment
All invoices are due within 14 days of the invoice date, unless otherwise agreed
Late payments will incur a statutory interest charge of 8% above the Bank of England base rate, in line with the Late Payment of Commercial Debts (Interest) Act 1998
We reserve the right to suspend work on your project if payment is overdue by more than 7 days
Final deliverables and source files will not be released until all outstanding invoices are settled in full
Expenses
Any third-party costs incurred on your behalf (such as font licences, stock imagery, domain registration, or print costs) will be agreed with you in advance and invoiced separately.
4. Revisions & Scope
The number of revision rounds included in your project will be stated in your proposal. Revisions are defined as reasonable amendments within the agreed scope — not redesigns or changes of creative direction.
Revisions must be submitted in a single consolidated round of feedback, not in multiple separate messages
Additional revisions beyond those included will be charged at our current hourly rate, which will be communicated to you in advance
Requests that constitute a significant change in scope or direction will be treated as a new phase of work and quoted accordingly
5. Client Responsibilities
The success of your project depends on timely, clear communication and the prompt supply of materials. As a client, you agree to:
Provide all required content, assets, copy, and information within agreed timeframes
Respond to questions, presentations, and revision requests within 5 working days unless otherwise agreed
Ensure that any materials you supply to us are legally owned by you, or that you have the appropriate rights and licences to use them
Ensure that a decision-maker with sign-off authority is available and engaged throughout the project
If the project is delayed due to late responses, missing materials, or lack of availability on your side, Tigerdot™ reserves the right to reschedule the project timeline or apply a holding fee to maintain your position in our schedule.
6. Intellectual Property
Our Existing IP
All methodologies, frameworks (including but not limited to the EVO™ framework), templates, processes, and background IP developed by Tigerdot™ remain the sole property of Tigerdot™ at all times. These are not transferred to you as part of any project.
Project Deliverables
Upon receipt of full payment, Tigerdot™ assigns to you the intellectual property rights to the final agreed deliverables for your commissioned project. This assignment covers the final brand identity, logo files, and design assets as outlined in the proposal.
Until full payment is received, all work — including concepts, drafts, and presentations — remains the intellectual property of Tigerdot™.
Website Content
All content on the Tigerdot™ website, including text, graphics, logos, images, and case study work, remains the property of Tigerdot™ unless otherwise credited. You may not reproduce, distribute, or use any of this content without our prior written consent.
Portfolio Rights
Unless you specifically request otherwise in writing before the project begins, Tigerdot™ reserves the right to display completed work in our portfolio, on our website, and on social media for promotional purposes.
7. Confidentiality
We treat all client information — including business strategy, financials, and commercially sensitive data — with strict confidentiality. We will not disclose your confidential information to any third party except:
Where required by law or a regulatory authority
To trusted subcontractors or suppliers who need access to deliver your project, and who are bound by equivalent confidentiality obligations
With your prior written consent
If you require a formal Non-Disclosure Agreement (NDA) before sharing sensitive information, please request this before our initial consultation. We are happy to sign a mutual NDA where appropriate.
8. Cancellation & Termination
Cancellation by You
If you choose to cancel the project after work has commenced:
The initial deposit is non-refundable under any circumstances
You will be liable for payment of all work completed up to the date of cancellation, invoiced at our day rate
Any third-party costs already incurred on your behalf will be invoiced in full
No final files or deliverables will be transferred upon cancellation
Cancellation by Tigerdot™
We reserve the right to terminate a project if:
Payment obligations are not met
The working relationship becomes untenable due to repeated unreasonable demands or unprofessional conduct
Circumstances arise that make delivery impossible
In the event of termination by Tigerdot™ for reasons other than client fault, we will refund a fair proportion of any deposit relating to work not yet completed.
9. Turnaround & Timelines
All timelines stated in proposals are estimates based on the project scope and the timely provision of materials and feedback by the client. Tigerdot™ will make every reasonable effort to meet agreed deadlines.
We are not liable for delays caused by late client feedback, missing materials, third-party suppliers, or circumstances outside our reasonable control (including illness, force majeure, or platform/technical outages).
10. Third-Party Services & Suppliers
Where a project requires third-party platforms, tools, or suppliers (such as website builders, printers, font foundries, or hosting providers), Tigerdot™ may recommend or facilitate access to these. However:
We are not responsible for the performance, availability, pricing, or terms of any third-party service
Any accounts or subscriptions set up in your name remain your responsibility
Tigerdot™ accepts no liability for losses arising from the failure, discontinuation, or change of terms of a third-party platform
11. Limitation of Liability
Tigerdot™ will deliver all services with reasonable professional skill and care. However, to the fullest extent permitted by law:
We are not liable for any indirect, incidental, consequential, or special damages arising from your use of our services
We are not liable for loss of revenue, loss of business, or loss of data arising from delays or project outcomes
Our total liability to you in connection with any project shall not exceed the total fees paid by you for that specific project
Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by negligence, or any other matter that cannot be excluded by law.
12. Warranties
You warrant that:
You have the legal right to use all content, trademarks, and materials you provide to us
The use of such materials by Tigerdot™ in delivering your project will not infringe the intellectual property rights of any third party
You will indemnify Tigerdot™ against any claims, costs, or losses arising from your breach of this warranty
Tigerdot™ warrants that the work delivered will be original creative work produced by us and will not knowingly infringe the intellectual property rights of any third party.
13. Governing Law & Disputes
These Terms & Conditions are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms or the services provided by Tigerdot™ shall be subject to the exclusive jurisdiction of the courts of England and Wales.
In the event of a dispute, both parties agree to first attempt to resolve the matter in good faith through direct communication before initiating formal proceedings.
14. Changes to These Terms
We may update these Terms & Conditions from time to time. The current version will always be published on our website with the date of last update. Continued use of our website or engagement of our services after any update constitutes acceptance of the revised Terms.
For active clients on ongoing projects, we will notify you of any material changes by email.
